Questions, answered.
How much does a personal injury lawyer cost?+
The consultation is free and we work on a contingency fee, so there is no attorney fee unless we win money for you. Clients may remain responsible for case costs and expenses, and we explain the terms in writing before you sign.
How long do I have to file a claim in New Mexico?+
Most New Mexico injury claims must be filed within three years, but claims against a government entity require notice within 90 days, and claims involving the Navajo Nation or a federal facility follow different, often shorter, deadlines. Call early.
My accident involved the Navajo Nation. Can you help?+
Yes. We regularly handle claims connected to the Navajo Nation, where the question of which court has authority is complex. Tell us the exact location and who was involved so the claim is filed in the right forum.
What if I was partly at fault?+
New Mexico uses pure comparative negligence, so you can recover even if you were partly, or mostly, at fault. Your compensation is reduced by your share of the blame.
Do I need a lawyer if the insurance company already made an offer?+
An early offer is almost never the full value of a claim. Insurers make quick offers before the extent of your injuries is known, and once you sign a release the claim is over. Have the offer reviewed before you accept it. The review is free.
How long does a personal injury case take in New Mexico?+
Straightforward claims can resolve in a few months. Serious-injury cases and cases involving the Navajo Nation or a federal facility take longer, often a year or more, because settling before you know the full extent of your injuries is usually a mistake.
Will my case go to trial?+
Most cases settle, but we prepare every case as if it will be tried to a jury. That preparation is what produces fair settlement offers, and if the insurer will not pay what the case is worth, we are ready to try it.
What types of cases do you handle?+
Car and truck accidents, wrongful death, accidents on the Navajo Nation, medical malpractice at IHS and tribal facilities, nursing home abuse, sexual and institutional abuse, civil rights and jail cases, and family law. See our results page for representative recoveries.
Do you handle cases outside Gallup?+
Yes. We represent clients across McKinley, San Juan, and Cibola counties, the Interstate 40 corridor to Albuquerque, and the Navajo Nation, in state, federal, and tribal court. The consultation is free and can be done by phone.
